Presenter's Profile:
Prof. Steven Gallagher

Steven Gallagher was awarded a first class LL.B.  He was called to the Bar of England and Wales in 2006.  Steven teaches equity and trusts, property law, and digital technology and law.  Steven also teaches a course on art, antiquities, cultural heritage and the law.  Steven has presented continuing professional development courses for solicitors in Hong Kong on many topics associated with property.  Steven’s research interests include equity and the law of trusts, art and cultural heritage law and legal history.  He is not a technologist.  In 2023 Steven published the first treatise dealing formally and systematically with all the major aspects of, and entitled, Digital Technology and Law.

Course Outline:

This 3-hour seminar will provide an update on important cases from Hong Kong and England which have involved the following: the availability of assets of trusts and companies to settle ancillary relief and other creditor actions after Prest v Petrodel Resources Limited [2013] UKSC 34 and Kan Lai Kwan v Poon Lok To Otto & HSBC International Trustee Limited [2014] HKEC 1174; illusory and sham trusts after the English High Court decision in JSC Mezhdunarodniy Promyshlenniy Bank and another v Pugachev (Pugachev v. Pugachev) [2017] EWHC 2426 (Ch); the (possible) resurrection of the presumption of resulting trust by the Privy Council in Marr v Collie (Bahamas) [2017] UKPC 17; and, joint ownership of bank accounts after Whitlock v Moree (Bahamas) [2017] UKPC 44.
